Welcome to DoctorAIPro. These Terms and Conditions ("Terms") govern your access to and use of the DoctorAIPro website, mobile application, and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

  • "You" refers to the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

  • "Content" refers to text, images, photos, audio, video, and all other forms of data or communication.
  • "User Content" means any Content that users submit, post, or display on or through the Service.

3. Account Registration and Eligibility

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2. Eligibility

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Content and Conduct

4.1. Content Responsibility

Our Service allows you to post, link, store, share and otherwise make available certain Content. You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

4.2. Content Ownership and Rights

By posting Content on or through the Service, you represent and warrant that:

  • You own the Content or have the right to use it and grant us the rights and license as provided in these Terms.
  • The posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

4.3. Content Rights

You retain any and all of your rights to any Content you submit, post, or display on or through the Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through the Service.

4.4. Content Monitoring

DoctorAIPro has the right but not the obligation to monitor and edit all Content provided by users.

4.5. Prohibited Use

You agree not to use the Service to:

  • Post or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Violate any applicable laws or regulations.

5. Intellectual Property Rights

5.1. DoctorAIPro Property

The Service and its original Content (excluding User Content), features, and functionality are and will remain the exclusive property of DoctorAIPro and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of DoctorAIPro.

5.2. User Content License

You acknowledge and agree that DoctorAIPro shall have the right (but not the obligation) to use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content in connection with operating and providing the Service.

6. Copyright Policy

6.1. Copyright Respect

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.

6.2. Copyright Claims

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to [email protected], with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged infringement.

6.3. False Claims

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through the Service on your copyright.

7. Pricing and Payment

7.1. Subscription Plans

DoctorAIPro offers various subscription plans for our Service. The pricing for these plans is listed on our website. By choosing a subscription plan and providing your payment information, you agree to pay the fees associated with the selected plan.

7.2. Free Trials

We may offer free trials of our Service. At the end of the free trial period, you will be automatically enrolled in the paid subscription plan unless you cancel your subscription before the trial period ends.

7.3. Price Changes

DoctorAIPro reserves the right to change our prices at any time. If we change the pricing of a subscription plan, we will provide notice of the change on our website or via email at least 14 days before the change takes effect. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount.

7.4. Refunds

Due to the nature of AI-powered medical services provided by DoctorAIPro.com, we do not offer refunds once the service has been accessed or used. Each interaction with our AI system consumes computational resources and provides immediate value through medical information and insights. As with other digital and AI-based services, all sales are final. We encourage users to carefully review our service offerings before making a purchase.

7.5. Taxes

Our prices do not include any taxes, levies, duties, or similar governmental assessments of any nature, including, for example, value-added, sales, use, or withholding taxes, assessable by any jurisdiction (collectively, "Taxes"). You are responsible for paying all Taxes associated with your purchase.

8. Product-Specific Terms

8.1. Content Guidelines

While DoctorAIPro encourages creativity and personal expression, we maintain certain content guidelines to ensure a safe and respectful environment for all users. Content that is explicitly sexual, violent, discriminatory, or otherwise inappropriate is not permitted. We reserve the right to remove any content that violates these guidelines without notice.

8.2. Age Restrictions

DoctorAIPro is intended for users aged 13 and above. Users between the ages of 13 and 18 should use the Service under the supervision of a parent or legal guardian. Certain features or templates may have additional age restrictions, which will be clearly indicated within the Service.

8.3. Privacy Settings

DoctorAIPro offers various privacy settings for your digital spaces. You are responsible for managing these settings and controlling who has access to your content. We strongly recommend reviewing and adjusting your privacy settings regularly.

8.4. Shared Spaces

Some features of DoctorAIPro may allow for shared digital spaces between users. By creating or joining a shared space, you agree that other invited users may contribute to, view, and potentially edit the content within that space. You are responsible for managing access to your shared spaces.

8.5. Third-Party Integrations

DoctorAIPro may offer integrations with third-party services for features such as music streaming or social media sharing. Use of these integrations is subject to the respective third-party's terms of service and privacy policy. We are not responsible for the practices of any third-party services.

8.6. Custom Domains

If you choose to use a custom domain for your DoctorAIPro space, you are responsible for obtaining, renewing, and maintaining that domain. We are not responsible for any issues arising from domain management.

8.7. Data Access and Retention

DoctorAIPro is designed as an integrated platform for creating and sharing digital spaces. Please be aware of the following regarding your data:

  • Content Creation: All content you create or upload to DoctorAIPro is stored on our servers and is accessible through your account while it remains active.
  • No Export Feature: DoctorAIPro does not currently offer a feature to export or download your data in bulk from the platform.
  • Content Ownership: You retain ownership of the content you create, but it is designed to be used within the DoctorAIPro ecosystem.
  • Account Termination and Data Retention: If you choose to terminate your account, your profile will be deactivated immediately. However, to comply with legal obligations or for backup purposes, we may retain your data for a period upto 15 days after account termination. After this period, all your content and personal data will be permanently deleted from our active systems and backups.

8.8. Individual User Spaces and Content Ownership

DoctorAIPro provides individual digital spaces for users to create and manage their content. Please be aware of the following regarding your personal space and content:

  • Individual Ownership: Each user's digital space and its content are owned solely by that user. DoctorAIPro does not offer shared spaces between users.
  • Content Responsibility: You are solely responsible for all content you create, upload, or manage in your personal space.
  • Privacy Settings: While you can control the visibility of your space through privacy settings, remember that any content you make public may be viewed by other users.
  • No Content Transfer: DoctorAIPro does not facilitate the transfer of content between users' spaces. Each space remains separate and individually managed.
  • Account Termination: If you choose to terminate your account, your profile will be deactivated immediately, and your content will no longer be accessible through DoctorAIPro platform. However, as stated in our data retention policy, your data may be retained for 15 days before being permanently deleted. We recommend saving any important content separately before initiating account termination, as DoctorAIPro does not offer a data export feature.

8.9. Intellectual Property in Templates

The templates provided by DoctorAIPro are licensed to you for use within the Service. You may not extract, copy, or use these templates outside of DoctorAIPro without explicit permission.

9. Termination

9.1. Termination by DoctorAIPro

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9.2. Termination by You

If you wish to terminate your account, you may simply discontinue using the Service.

9.3. Effect of Termination

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

10. Limitation of Liability

In no event shall DoctorAIPro, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or Content of any third party on the Service;
  • Any Content obtained from the Service; and
  • Unauthorized access, use or alteration of your transmissions or Content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Disclaimer

11.1. Service "As Is"

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

11.2. No Warranties

DoctorAIPro, its subsidiaries, affiliates, and its licensors do not warrant that:

  • The Service will function uninterrupted, secure or available at any particular time or location;
  • Any errors or defects will be corrected;
  • The Service is free of viruses or other harmful components;
  • The results of using the Service will meet your requirements.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
